Training Booking Terms and Conditions

Terms and Conditions – Blue Screen IT v1.3-2011

Parties who apply

All goods and services supplied by Blue Screen IT Ltd are subject to the terms and conditions stated within this document. Any party deemed a client of Blue Screen IT Ltd, by definition one that has been supplied goods or services from Blue Screen IT, apply to the terms and conditions stated within this document.

Acceptance

Your acceptance of contact will be deemed successful upon the completion and receipt of your purchase order, booking form or other written intention to confirm your booking or goods provision. You will be deemed to have accepted all goods upon their delivery by us to the address specified in the order. In the event of equipment supply, we must be informed in writing within 7 days of acceptance of the order of any changes, alterations, reductions or cancellations. We reserve the right to retain any deposits or charge in full for any goods supplied or fabricated where cancellation is not made within the period specified.

Price

If the rate of value added tax (VAT) increases between the date of your order and the date of delivery we will add the necessary additional amount of value added tax to the price of the goods. If the price of the goods increases for any other reason between the date of your order and the date of delivery we will notify you of this and give you the choice of accepting the price increase or cancelling the order in which case any deposit paid by you will be refunded in full.

Payment

Course fees, fully inclusive, may be paid in advance, but must be paid in full at the latest upon arrival at the Training Centre, prior to commencement of the course.  In the event that a delay is anticipated, leniency will be provided only if the company should see fit and have agreed in advance to do so with the party requesting the course. Acceptable methods of payment are Unit, Personal or Building Society Cheque, BACS or Cash.  Cheques should be made payable to Blue Screen IT Limited and sent to Blue Screen IT Ltd, 7 Darklake view, Estover, Plymouth, Devon, PL67TL.

A delegate payment deposit on a course will secure their seat within the booked course, however all fees must be paid up in full by 13:00 on the First day of the course. This means that the course fees should be in cleared funds by this day and time, available to Blue Screen IT Ltd as transferable income. Full payment and deposits therefore are the only ways to secure a seat on the course. To follow the course through all payments should be cleared on course commencement and time as mentioned above.

The company reserves the right to adjust the sum payable by the client to take account of market forces. The client would be informed of any price changes if applicable within two weeks of commencement of their course. All prices quoted by quotation or pro-forma are valid strictly for 30 Days.

Cancellation of Course by the Company

In extreme circumstances, the company may find it necessary to reschedule a course booking. The client will be notified, and an alternative course date will be offered. The company’s liability will be limited to a refund of fees paid should rescheduled dates not be convenient. The company does not accept responsibility for any claims for consequential loss due to time off or departmental scheduling by the client.

Cancellation of Course by the Client

Refund of course fees will only be accepted on receipt of written notification to the company within at least fourteen (14) calendar days of the start of the course. It is the client’s responsibility to ensure that they have received a written acknowledgement of the cancellation.  If a client withdraws from a course once that course has commenced or does not attend the first day, the client shall pay the full invoiced amount for that course. If a client fails to confirm a course cancellation with Blue Screen IT Ltd within at least fourteen (14) calendar days of course commencement, the client will be liable for the cost of the course in full by the date of commencement of the clients intended course. No fees will be added to provide an alternate training date for the delegate.

Obligation to provide service

The company’s brochures, correspondence and literature are not binding, and variations may be made to the services provided without prior consent of the client or individual. The company reserves the right to alter the venue for training within reasonable distance, and can refuse or curtail any training course if the client fails to satisfy the requirements for such a course.

Force Majeure

We shall not be liable for delay or failure to perform any of our obligations under this order if the delay or failure is caused by any circumstances beyond our reasonable control. For the purposes of this condition, "force majeure" shall include, but not be limited to acts of God, war, terrorism, civil disorder, sonic book, industrial dispute, fire or explosions. Upon the happening of a "force majeure" event we shall be entitled to a reasonable extension of time for the performance of our obligations.

Delegate etiquette

All delegates are expected to dress and behave in a manner suitable to the training environment. Any delegates that disrupt, or severely impede a course due to incorrect etiquette will be made liable for any course ill repute. Any delegates found “tampering” with the classroom environment will be held liable for any loss of class time due to rescheduling. This will include the full cost of the course and any further costs involved in labour and parts at Blue Screen IT Ltd current consultancy rate.

Guarantees

We do not provide additional guarantees.

Exclusions

We do not exclude liability for death or personal injury, however we shall not be liable for any direct loss or damage suffered by you howsoever caused, as a result of any negligence, breach of contract, misrepresentation or otherwise. We shall not under any circumstances be liable for any indirect or consequential loss howsoever caused whether by negligence, breach of contract, misrepresentation or otherwise. We or our insurers shall not be liable or investigate any claim for loss unless you have given us written notice within 7 days of its occurrence and given us or our insurers every facility to investigate such occurrence.

Copyright

All intellectual property rights, including copyright, patents, course materials and courseware remain the property of the company. No copies are to be made of any course notes or study materials without prior permission of the board of directors.

All copyrights, trademarks and logos of third-party vendors, neutral and vendor specific, are the property of their respective owners. This applies to individual, corporate, governmental and other sectors. All logos displayed are done so to best represent companies and organizations referred to. This under no circumstance implies any partnership or membership of the body or organization.

Individual Responsibility

Whilst the company will always endeavor to give best client advice, it is the client’s ultimate responsibility to ensure that the course selected is suitable for their requirements. The company cannot accept responsibility for selection of the wrong course. Blue Screen IT is a provider of vendor-neutral and vendor-specific certifications, the client carries the responsibility that the course is as the client intended.

Data secrecy

Blue Screen IT Ltd employs a strict data secrecy policy. We under no circumstance pass out this information to any other 3rd party organizations. We do not participate in any marketing, demographics or tracking programs. Only under legal or lawful situations where Blue Screen IT Ltd is obliged to do so will company data be submitted. If you or any other parties affected are approached by a third party organization claiming to have received information from Blue Screen IT Ltd, do not submit any further information and contact us immediately with the details to the incident for further action.

Where any goods or services are required under sensitive circumstances, Blue Screen IT Ltd has a standard Data Protection and Customer Secrecy Policy. If any policies are required on your part, Blue Screen IT Directorate will always oblige to preserve customer confidence.

Summary and Complaints

The terms and conditions stated above are binding and are in place to protect the interests of both the client and that of Blue Screen IT Ltd. Where any terms and conditions are not clear or in understandable format, or you wish to make a complaint, please do not hesitate to contact Blue Screen IT Directorate on info@bluescreenit.co.uk.
